Anthony enthusiastically bought a building lot at Divot Acres, a sportsman's dream development combining a golf course and a lake for water sports. But the developer extended the golf course to within fifty feet of Anthony's back door. Then the course was opened to nonresidents who jammed it and also Anthony's back yard. Anthony sued to make the developer move the offending fourth hole and tee.
"Half of these alleged golfers are such hackers that they hit the ball into my yard and then play iron shots out of my flower beds," Anthony complained. "Low drives endanger my children. Also, the kids get bawled out by golfers, who demand utter silence when about to tee off. One even knocked out my dog with a brassie to keep him from barking."
"Certainly Anthony should be protected from individuals trespassing on his property, but that doesn't mean that the whole club should be halted from lawful use of a golf course which was there when he moved in," the developer's lawyer argued. Then, speaking ardently as a golfer, he added: "To move that fourth tee would spoil the course."

Anthony won. The court said: ". . . the ordinary tactics of golfers at the tee wreak havoc with plaintiff's comfort and reasonable sensibilities." It ordered the tee to be moved as preferable to "the travail to be suffered by perpetuation of the present method of play." Based upon a 1959 New Jersey decision.
